These Terms govern your purchase of TAP8 NFC products. You give us your details to place an order — we make your product and ship it to you. People who tap your finished product are not required to give us or you any personal information. We offer a 3-month replacement guarantee on manufacturing defects, on top of your rights under NZ law. If something goes wrong, email support@tap8.co.nz first.

— 01 · WHO WE ARE

CLAUSE 1
Business Information

TAP8 ("we", "us", "our") is a New Zealand-registered business based in Christchurch, New Zealand. We design and supply NFC-enabled physical products including cards, tags, and wristbands that link to a webpage when tapped by a smartphone. Our contact email is support@tap8.co.nz.

CLAUSE 2
Agreement

By submitting an enquiry or placing an order with TAP8, you confirm you have read and agreed to these Terms. If ordering on behalf of a business, you confirm you have authority to bind that business to these Terms.

— 03 · PRODUCTS & ORDERS

CLAUSE 3.1
How TAP8 Products Work

TAP8 products are physical NFC-enabled items (cards, tags, wristbands). When a smartphone is tapped against a TAP8 product, it opens a webpage chosen and configured by the product owner (you, our customer). The person tapping the product is not required to provide any personal information to TAP8 or to the product owner as a result of the tap itself. The destination webpage is the product owner's responsibility.

CLAUSE 3.2
Device Compatibility

TAP8 products use NTAG-series NFC chips, compatible with iPhone 7 and above (iOS 13+) and most Android devices from 2015 onward with NFC enabled. We do not guarantee compatibility with older or non-standard devices. Very thick phone cases may reduce tap reliability. We recommend tapping near the top-rear of the phone where the NFC antenna is located.

CLAUSE 3.3
Custom & Personalised Orders

Most TAP8 products are custom-made to your specifications (engraving, branding, profile URL). Once production has commenced, changes cannot be made. Custom and personalised orders cannot be returned for change of mind, as permitted under the Consumer Guarantees Act 1993. You confirm all content is correct and that you have the legal right to use it.

CLAUSE 3.4
Pricing & GST

All prices displayed on consumer-facing pages are in New Zealand Dollars (NZD) and are GST-inclusive unless explicitly marked otherwise. B2B quotes may be presented GST-exclusive and will be clearly labelled. Prices may change without notice — confirmed and paid orders are honoured at the price agreed at confirmation.

CLAUSE 3.5
Order Acceptance

Your order is not accepted until we issue a written order confirmation by email. We reserve the right to decline any order, including in cases of pricing errors, unavailability, or suspected fraud. Any payment received for a declined order will be refunded in full.

CLAUSE 4
Payment Terms

Full payment is required before production commences on standard orders. Alternative payment terms for bulk business orders may be agreed in writing prior to production. We do not store payment card details — all payment processing is handled by PCI-compliant third-party processors. Accepted payment methods are listed in your quote or at checkout.

— 05 · DELIVERY & SHIPPING

CLAUSE 5.1
Timeframes

Standard production is 5–10 business days. NZ courier delivery is typically 2–5 business days from dispatch. Timeframes are estimates and may vary. We are not liable for delays caused by courier services, natural events, or other circumstances outside our control. We ship nationwide from Christchurch.

CLAUSE 5.2
Delivery Address & Risk

You are responsible for providing a correct delivery address at the time of order. If a parcel is returned due to an incorrect address, a redelivery fee may apply. Risk of loss or damage passes to you once goods are dispatched to the courier. If you arranged your own courier collection, risk transfers at the point of pickup.

— 06 · GUARANTEE, RETURNS & YOUR CGA RIGHTS

— YOUR STATUTORY RIGHTS · CANNOT BE EXCLUDED

Under the Consumer Guarantees Act 1993 (NZ), our products come with guarantees that cannot be excluded for consumer purchases — including that goods are of acceptable quality, fit for purpose, and match their description. Nothing in these Terms limits any rights you have under the CGA or Fair Trading Act 1986. For purchases made for business purposes, CGA guarantees may be excluded by written agreement as permitted under s.43 CGA.

CLAUSE 6.1
TAP8 3-Month Replacement Guarantee

In addition to your statutory rights, TAP8 provides a 3-month replacement guarantee on manufacturing defects from the date of delivery. If your product fails through no fault of your own within that period, we will replace it at no cost. This guarantee does not cover: physical damage, water damage (unless sold as waterproof), misuse, loss, or failure caused by third-party platforms or URLs you have linked to the product. CLAUSE 6.2
How to Make a Claim

Email support@tap8.co.nz with your order number, a description of the issue, and a photo where possible. We will assess and respond within 3 business days. If the defect is confirmed as ours, we cover return postage. If the claim is not upheld, return postage is at your cost.

— 07 · NFC TECHNOLOGY DISCLAIMER

CLAUSE 7
Technology Limitations

TAP8 is not liable for: device incompatibility with older or non-standard smartphones; changes by Apple, Google, or other OS providers that affect NFC behaviour; disruption to third-party websites or services you have linked to your product; failure to tap caused by thick cases or disabled NFC settings; or loss of data hosted on third-party platforms you have connected. The destination URL linked to your TAP8 product is entirely your responsibility to maintain and keep appropriate.

— 08 · INTELLECTUAL PROPERTY

CLAUSE 8
Ownership & Customer IP Warranty

All TAP8 website content, product designs, brand elements, and copy are our intellectual property. You may not reproduce or use our brand without written permission. For custom orders, you warrant that any logo, artwork, or content you supply for production does not infringe any third party's intellectual property rights. You indemnify TAP8 against any claim arising from customer-supplied content.

— 09 · ACCEPTABLE USE

CLAUSE 9
Prohibited Uses

You must not configure or link a TAP8 NFC product to any destination that is unlawful, deceptive, harmful, defamatory, or that infringes the rights of any person. This includes scam or phishing sites, adult content without appropriate age gating, malware, or any content that violates NZ law. TAP8 reserves the right to deactivate any NFC profile found to be in breach of this clause, without notice and without refund.

— 10 · LIMITATION OF LIABILITY

CLAUSE 10
Liability Cap

To the maximum extent permitted by NZ law, TAP8's total liability for any claim shall not exceed the amount you paid for the relevant product(s). We are not liable for indirect, consequential, or special losses including lost profits, lost data, or business interruption. This does not limit liability for personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by NZ law.

— 11 · GOVERNING LAW & DISPUTES

CLAUSE 11
Dispute Resolution

These Terms are governed by the laws of New Zealand. Disputes should first be raised with us at support@tap8.co.nz. If unresolved, disputes may be referred to the Disputes Tribunal of New Zealand (claims under $30,000) or the relevant NZ courts. You may also contact the Commerce Commission, Privacy Commissioner, or Consumer Protection MBIE as appropriate.

— 12 · CHANGES TO TERMS

CLAUSE 12
Amendments

We may update these Terms at any time. The current version with effective date is always published on our website. Material changes will be communicated to existing customers by email where practicable. Continued use of our products or website after changes constitutes acceptance of the updated Terms.
